Terms of Service
Age requirement: You must be 18 years of age or older to create an account on YourGuru. By creating an account you confirm that you are an adult and are creating child profiles only for children under your parental or guardian responsibility.
1. Acceptance of terms
By accessing or using YourGuru (the Service), you agree to be bound by these Terms of Service (Terms) and our Privacy Policy. If you do not agree, you may not use the Service.
These Terms constitute a legally binding agreement between you and Aarush Innovations (Company, we, us).
2. Eligibility
- You must be at least 18 years old to create a parent account.
- You must have the legal capacity to enter into a binding contract in your jurisdiction.
- You must be the parent or legal guardian of any child for whom you create a child profile.
- Children may not create their own accounts or independently access the Service.
3. Your account
3.1 Account responsibility
You are responsible for maintaining the confidentiality of your account credentials, including your Parent Mode PIN. You are responsible for all activity that occurs under your account.
3.2 Accurate information
You agree to provide accurate, current, and complete information when creating your account and child profiles, and to keep this information updated.
3.3 Account security
You must notify us immediately at support@yourguru.app if you suspect unauthorised access to your account.
4. The Service
4.1 What we provide
YourGuru provides an AI-powered personalised tutoring service for children. The Service includes:
- Personalised AI tutor generation from an approved loved-one audio or video recording
- Curriculum-aligned daily learning sessions
- Question and answer support
- Session replays and progress tracking
- Parent dashboard, safety controls, and child profile management
4.2 Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or experience downtime. We will endeavour to provide advance notice of planned maintenance.
4.3 AI-generated content
The tutoring content provided by YourGuru is AI-generated and designed to be curriculum-aligned and educationally appropriate. However, AI-generated content may occasionally contain errors. We recommend parents review their child's sessions periodically. YourGuru is a supplemental learning tool and is not a replacement for qualified human teaching, school, medical advice, legal advice, mental health advice, or emergency help.
5. Recordings and AI tutor generation
5.1 Your permission to us
By submitting or capturing a loved-one recording, you confirm that you have the right and consent required to use that person's voice, face, likeness, and recording for the child's personalised tutor experience. You grant us the rights needed to host, process, transform, display, generate, moderate, secure, and operate the tutor experience using that content.
5.2 How recordings are used
Recordings, generated media, transcripts, prompts, answers, learning interactions, and derived educational data may be processed to operate, secure, personalise, evaluate, and improve YourGuru, including proprietary teaching technology and AI systems. We do not sell child data.
5.3 Your right to remove
You may delete or replace recordings from Parent Mode where supported. Deleting a recording may remove or reduce the personalised tutor experience. Account deletion triggers deletion of recordings and generated media as described in the Privacy Policy.
5.4 Restrictions
You must not submit recordings of another person without explicit, informed consent. You must not use the Service to impersonate, deceive, harass, exploit, or harm anyone.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, abusive, sexual, exploitative, violent, deceptive, or privacy-invasive purpose
- Use the Service in a way that harms minors or attempts to bypass child-safety controls
- Submit recordings or content you do not have rights or consent to use
- Attempt to reverse-engineer, extract, copy, or reproduce the AI tutor models, prompts, systems, or platform logic
- Attempt to bypass security controls, including Parent Mode PIN protection
- Share your account credentials with others outside your household
- Use automated means to access the Service without authorisation
7. Subscriptions and billing
7.1 Free plan
A free tier may be available with limited features as described on the pricing page. No payment details are required for the free plan unless you upgrade.
7.2 Paid plans
Paid subscriptions, coupons, add-ons, renewals, cancellations, refunds, and taxes are handled through the payment provider and the plan terms shown at purchase. Prices may be updated with notice where required by law.
7.3 Cancellation and refunds
You may cancel your subscription from Parent Mode where available. Cancellation generally takes effect at the end of the current billing period. Refund requests are considered according to the Refund Policy and applicable consumer protection laws.
8. Intellectual property
8.1 Our IP
The Service, including software, AI systems, generated workflows, design, branding, curriculum processing, and platform content, is owned by or licensed to Aarush Innovations. You may not reproduce, modify, or distribute any part of it without our written permission.
8.2 Your content
You retain ownership of content you provide. You grant us the rights needed to operate, secure, personalise, moderate, support, evaluate, and improve the Service using that content as described in these Terms and the Privacy Policy. Generated outputs are provided for personal learning use under your account.
9. Privacy and children's data
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We apply protections required for children's data, including India's Digital Personal Data Protection Act, 2023 (DPDP Act), and use strong child-privacy safeguards where relevant. Parents retain rights over their children's data as described in the Privacy Policy.
10. Disclaimers
The Service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Service will meet your specific educational requirements or that AI-generated tutoring content will be error-free.
11. Limitation of liability
To the maximum extent permitted by applicable law, Aarush Innovations shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
Nothing in these Terms limits liability for fraud, death, personal injury caused by negligence, or any liability that cannot be limited by law.
12. Suspension, termination, and deletion
We may restrict, suspend, or terminate access if we detect unsafe use, policy violations, fraud, security risk, payment abuse, or legal risk. We may preserve limited information needed to investigate abuse, enforce these Terms, resolve disputes, or meet legal obligations.
You may request account deletion at any time. Account deletion disables access and triggers deletion of account data, child data, recordings, generated media, learning history, and archives within 30 days, except limited records retained for legal, security, billing, audit, tax, fraud prevention, or dispute purposes.
13. Governing law and disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India, while applicable consumer protection forums remain available as provided by law.
14. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or prominent in-app notice where required. Material changes may require re-acceptance before continued use of the Service. The accepted document version is stored with your parent account.
